"Defect" and "Defective" in Product Liability Litigation:

The terms "defect" and "defective" have fairly broad meanings in product liability law. Any product that is unreasonably dangerous when used as intended could be considered defective. Of course many products may be inherently dangerous, such as a sharp knife, but not considered unreasonably dangerous. If the design of the knife was faulty or it was poorly manufactured, then the knife would be considered defective. If this product defect then resulted in injury to someone using the product as it was intended, the manufacturer could be held liable. A product may also be considered defective if the packaging does not adequately warn consumers about certain dangers. The product liability lawyers at our locations in Louisiana, Texas, and Mississippi know how to assess liability in cases involving injury or death from defective products.

Some Examples of Defective Products:

Defective Medical Devices

Automotive Defects (Crashworthiness)

  • Defective seatbelts
  • Defective airbags

  • Power tools
  • Electric appliances

Ortho Evra® Patch

On November 10 th, 2005, the FDA required Ortho-McNeil Pharmaceutical, a Johnson & Johnson subsidiary, to put a bold-faced warning on the packaging for the Ortho Evra® birth control patch. The warning must state that patch users may be exposed to 60% more estrogen than with a 35-microgram birth control pill. The Ortho Evra® patch is only intended to deliver 25-microgram “doses” of estrogen.

Research has shown that excessive estrogen exposure is linked to heart attack, stroke, and blood clots in the legs and lungs. Due to the apparent risks, some public health advocates have discouraged women from using the Ortho Evra® patch instead of second-generation birth control pills.

If your loved one suffered a blood clot, stroke, or heart attack while using the Ortho Evra® birth control patch, please contact Lundy & Davis today to learn how we can help.
